These Terms of Service (“Terms”) govern your access to and use of PlutoPro (“the Service”), operated by Noble Nest sp. z o.o. (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
The Service is provided by:
PlutoPro is an AI-powered software-as-a-service platform that helps ecommerce sellers create social media content. The Service imports product data from connected stores (Amazon, Shopify, Etsy) and Google Drive, generates text and image content using artificial intelligence, and provides tools to review, edit, and export that content for platforms including Pinterest and Instagram.
The Service is primarily intended for business use by ecommerce sellers and their staff. Where an individual consumer subscribes, the mandatory consumer-protection provisions of Polish and EU law apply in addition to these Terms.
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@plutopro.ai if you suspect unauthorised access to your account.
PlutoPro offers a free tier and paid subscription plans. Current pricing is displayed on our pricing page at plutopro.ai/pricing. Prices are shown net of applicable VAT; VAT is added at checkout where applicable. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorise us (via Stripe) to charge your payment method on each billing cycle until you cancel.
Each plan includes two independent usage caps. The monthly approval limit caps the number of drafts you can approve for export in a billing period (only approved drafts count toward this total — generated drafts you reject or regenerate do not). The daily generation cap is a fair-use limit on the number of new drafts you can generate each day, intended to prevent abuse of our AI compute resources. Unused capacity does not roll over.
The daily generation cap resets at 00:00 UTC each day; the monthly approval limit resets on your billing date. If you reach either limit, you may upgrade your plan at any time to lift both caps. The specific limit values for each tier are published on our pricing page and may be updated with at least 30 days' notice for material decreases.
You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to your paid plan features until the end of your current billing period. We do not provide prorated refunds for partial billing periods except where required by mandatory law.
If you are a consumer resident in the EU, you normally have a 14-day right of withdrawal under the Consumer Rights Directive. By starting to use the Service (accessing the Queue, generating a draft, connecting a store) before the 14-day period expires, you request immediate performance and acknowledge that you lose the right of withdrawal once the digital service has been fully supplied with your express consent, in accordance with Art. 16(m) of Directive 2011/83/EU and Art. 38(13) of the Polish Consumer Rights Act. If you have not used the Service, you may withdraw within 14 days by contacting support@plutopro.ai for a full refund.
When you connect an ecommerce store (Amazon, Shopify, Etsy) or Google Drive to PlutoPro, you authorise us to access the data necessary to provide the Service — specifically, product listings, images, and associated metadata. For Amazon connections, we use the Selling Partner API under the roles you authorise; we do not retrieve buyer personal information, order data, or financial data.
You represent and warrant that you have the right to share this data with PlutoPro and that your use of the Service does not violate the terms of service of any connected platform, including but not limited to Amazon's Acceptable Use Policy and Data Protection Policy.
You may disconnect a store at any time from your account settings. Upon disconnection, we stop syncing new data from that store and delete the associated encrypted credentials. Previously imported product data remains in your account until you delete it or delete your account.
Content generated by PlutoPro using your product data and brand preferences belongs to you. You are free to use, modify, and distribute generated content as you see fit. We claim no ownership over content generated for your account.
AI-generated content may contain inaccuracies, and images may not perfectly represent your products. You are responsible for reviewing all generated content before publishing. PlutoPro provides content as drafts for your review — we do not guarantee the accuracy, suitability, or effectiveness of any generated content.
PlutoPro does not guarantee any specific outcomes from using generated content, including but not limited to increased sales, engagement, followers, or traffic. Results depend on many factors outside our control.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these Terms, subject to prior notice where reasonably practicable.
The PlutoPro platform, including its design, code, AI prompts, branding, and documentation, is owned by Noble Nest sp. z o.o. and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described here.
Your product data, brand assets, and store content remain your property. By using the Service, you grant us a limited, non-exclusive, worldwide licence to process your data solely for the purpose of providing the Service to you.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
If you believe the Service has not been provided in accordance with these Terms, you may file a complaint by emailing support@plutopro.ai with “Complaint” in the subject line. Please describe the issue, the account affected, and any relevant dates. We will acknowledge receipt within 7 days and respond substantively within 30 days.
EU consumers may also submit disputes to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Use of the ODR platform is voluntary.
To the maximum extent permitted by law, Noble Nest sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
For business customers, our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits or excludes our liability for gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be limited or excluded under mandatory Polish or EU law. If you are a consumer, your mandatory statutory rights are not affected by these Terms.
If you use the Service as a business, you agree to indemnify and hold harmless Noble Nest sp. z o.o., its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service in breach of these Terms or your violation of any third-party rights. This clause does not apply to consumers.
We may suspend or terminate your access to the Service for material breach of these Terms, with prior notice where reasonably practicable. You may terminate your account at any time through your account settings.
Upon termination, your right to use the Service ceases immediately. Personal data is deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the Republic of Poland. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
For business customers, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the common courts competent for the registered seat of Noble Nest sp. z o.o. (Warsaw, Poland).
For consumers, nothing in this clause deprives you of the protection of mandatory consumer-law provisions of your country of residence, including the right to bring proceedings in the courts of your place of domicile, as provided by Regulation (EU) 1215/2012 (Brussels I recast).
We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. For significant changes, we will notify you via email at least 30 days before they take effect. If you do not agree to the revised Terms, you may cancel your subscription before they take effect; continued use of the Service after the effective date constitutes acceptance of the revised Terms.
